Land Use & Zoning
Paul T. Swanicke Esq. represents both developers and property owners in all types of applications for commercial and residential development before municipal, county, and state administrative agencies throughout New Jersey. Possible land use or zoning issues could be:
| Subdivisions & site plans | The subdivision of land involves the legal division of a parcel into a number of lots for the purpose of development and sale. The subdivision and development of individual parcels must conform to the provisions of local zoning which contain use and dimensional requirements for land development. A site plan shows the proposed development and use of a single parcel of land consisting of a map and all necessary supporting material. |
| Condemnation & Eminent Domain | The legal process by which the government takes private land for public use, paying the owners a fair price. |
| Use Variance | A variance that allows landowners to put their land to a use that is not permitted under the zoning law. This type of variance may be granted only in cases of unnecessary hardship. To prove unnecessary hardship, the owner must establish that the requested variance meets four statutorily prescribed conditions. If a parcel of land is zoned for single-family residential use and the owner wishes to operate a retail business, the owner must apply to the zoning board of appeals for a use variance. |
| Environmental Issues | Permits, testing and reviews required by State and/or local agencies for land use approvals where the proposed project may have an environmental impact, or environmental issues pre-exist and remediation is required. |
